Sotomayor Hearings Begin

Serious issues of concern have been raised about the impartiality of Judge Sonia Sotomayor’s rulings on the 2nd Amendment and property rights, and whether she will judge with “empathy” rather than treating all litigants fairly.  Justice is blind in order to judge without favoritism. 

Equal Justice Under Law

Senator Jeff Sessions (R-Ala., top Republican on the Senate Judiciary Committee) points out that “blind, equal justice is the foundation of our remarkable legal system and the bulwark of our shared freedoms.”  But President Obama disagrees, claiming that when “constitutional text will not be directly on point,” the critical ingredient for a judge is the “depth and breadth of one’s empathy,” as well as “their broader vision of what America should be (emphasis mine and throughout).”  But when one side is shown empathy, is not the other shown prejudice?

The New Haven, CT case aside, a judge’s failure to suspend biases and rule impartially can or cannot be measured in previous decisions as compared to their oath of office (Judicial Oath):

I do solemnly swear that I will administer justice without respect to persons (emphasis mine) and do equal right to the poor and to the rich, and that I will faithfully and impartially discharge and perform all the duties incumbent upon me under the Constitution and laws of the United States. So help me God.”

If confirmed, she will have the power to define or redefine the meaning of our Constitution and determine the rights and freedoms for every citizen in America.  Do you think Judge Sonia Sotomajor should be approved as the next Associate Justice of the U.S. Supreme Court?  Why or why not?
