If ever the people of the United States rise up and fight over passage of Obamacare, Harry Reid must be remembered as the man who sacrificed the dignity of his office for a few pieces of silver. The rules of fair play that have kept the basic integrity of the Republic alive have died with Harry Reid. Reid has slipped in a provision into the health care legislation prohibiting future Congresses from changing any regulations imposed on Americans by the Independent Medicare [note: originally referred to as “medical”] Advisory Boards, which are commonly called the “Death Panels.”

It was Reid leading the Democrats who ignored 200 years of Senate precedents to rule that Senator Sanders could withdraw his amendment while it was being read.

It was Reid leading the Democrats who has determined again and again over the past few days that hundreds of years of accumulated Senate parliamentary rulings have no bearing on the health care vote.  [emphasis mine and throughout]

On December 21, 2009, however, Harry Reid sold out the Republic in toto.

Upon examination of Senator Harry Reid’s amendment to the health care legislation, Senators discovered section 3403. That section changes the rules of the United States Senate.

To change the rules of the United States Senate, there must be sixty-seven votes.

Section 3403 of Senator Harry Reid’s amendment requires that “it shall not be in order in the Senate or the House of Representatives to consider any bill, resolution, amendment, or conference report that would repeal or otherwise change this subsection.” The good news is that this only applies to one section of the Obamacare legislation. The bad news is that it applies to regulations imposed on doctors and patients by the Independent Medicare Advisory Boards a/k/a the Death Panels.

Section 3403 of Senator Reid’s legislation also states, “Notwithstanding rule XV of the Standing Rules of the Senate, a committee amendment described in subparagraph (A) may include matter not within the jurisdiction of the Committee on Finance if that matter is relevant to a proposal contained in the bill submitted under subsection (c)(3).” In short, it sets up a rule to ignore another Senate rule.

Senator Jim DeMint confronted the Democrats over Reid’s language. In the past, the Senate Parliamentarian has repeatedly determined that any legislation that also changes the internal standing rules of the Senate must have a two-thirds vote to pass because to change Senate rules, a two-thirds vote is required. Today, the Senate President, acting on the advice of the Senate Parliamentarian, ruled that these rules changes are actually just procedural changes and, despite what the actual words of the legislation say, are not rules changes. Therefore, a two-thirds vote is not needed in contravention to longstanding Senate precedent.

We led the efforts of our members to contact every single Senator after the House passed their health care bill, to DEMAND that they reject Harry Reid’s “motion to proceed” on the ObamaCare bill — and as a result, over two hundred and sixteen thousand faxes FLOODED those Senate offices!

 
We just barely missed winning on this first vote… but WE CAN STILL DEFEAT THE BILL. The bill pushed by Obama, and passed by leftist Democrats in the House, is NOT getting the full support of every Democrat in the U.S. Senate; and without all 60 of those votes, they will NOT be able to pass the NEXT cloture vote coming up soon…

Which means that we can STILL defeat it there — IF we can overwhelm every Senator with our demands to STOP it!

Here’s what Erick Erickson at RedState.com is reporting:

The Democrats have given Joe Lieberman everything he wanted. Joe will now vote for the bill. Ben Nelson (D-NE) is being threatened with having every major military installation in Nebraska shut down. Yes, I know, but the Democrats are playing for keeps on this and health care “reform” is more important to them than the military. Liberals are being told they have to accept this to given them any credibility going into next year’s election. They don’t want to be accused of “killing reform.” Lastly, the CBO scoring of the bill is going to look fine now that the Medicare affecting portions are going to be dropped. Inevitably, this legislation is going to cause health care costs to skyrocket and force people into socialized medicine. But Barack Obama and the Democrats don’t care. They want to be seen as doing something and beating the Republicans – with what, they don’t care.

But we have NOT lost this fight. Harry Reid STILL does not have all 60 votes he needs to enact cloture and force a vote on his bill. For example, Sen. James Webb (D-VA), who voted with conservatives five times for amendments that would have prevented Reid from slashing Medicare funding, is “still undecided.” Sen. Claire McCaskill (D-MO) said she would vote against the bill if it raised health care costs overall — which it does, by $234 billion. Sen. Olympia Snowe (R-ME) refused to say on Tuesday if she’s leaning towards supporting the healthcare bill. Sen. Susan Collins (R-ME) says the bill is “still too deeply flawed for me to support it.” And even Sen. Ben Nelson was still telling Politico yesterday, “I’m not on the bill. I have spoken with the president and he knows they are not wrapped up today. I think everybody understands they are not wrapped up today and that impression will not be given.”

So, even though Harry Reid was able to strong-arm enough of his Senators to vote for his “cloture” motion to proceed to debate — something that is usually just a procedural vote! — he STILL doesn’t have enough votes to enact cloture in order to get a final vote, which means THE BILL WOULD DIE!

We CAN still win, by keeping the Democrats from getting the 60 votes they need on the next cloture vote, scheduled for THIS WEEK… but we can’t do it without YOUR help!

 Remember, this bill is the worst of all possible bills. It’s chock full of every far-left special interest socialistic dream imaginable. Here’s some of what’s in its TWO THOUSAND PAGES:

• The CBO estimates that H.R. 3962, the health bill that the House passed, would cost $1.2 TRILLION over 10 years, including the cost to states for mandated Medicaid expansion ($34 billion), the “Doc Fix” ($245 billion), and authorized discretionary spending for grants, public programs, changes and funding for a variety of agencies that would be responsible for implementing H.R. 3962.
• The bill protects trial lawyers. The bill gives money (authorized at “such sums”) to states that enact “certificate of merit” (a document signed by a medical professional that says there is a probability that the standard of care was violated) and / or a certificate of “early offer” (an early, confidential apology) laws, as long as the states don’t limit attorneys’ fees or impose caps on damages.
• The current version will give billions of dollars of taxpayer healthcare benefits to ILLEGAL ALIENS in America. It would allow illegal aliens to use the new healthcare “exchange” and would not require verification to keep illegal aliens out of the other parts of the proposed federal healthcare system. Members of the Congressional Hispanic Caucus fought back against reports that leaders would add Senate language to block illegal immigrants from participating in the insurance exchange.
• It will create a nationwide federal government program, the “public option,” which will pay for abortion on demand — with federal funds, of course, because that is what federal agencies spend.

Liberals in the House AND the Senate ignored us when the majority said, “NO BAILOUT.” They ignored us when the majority said, “NO FAKE STIMULUS.” Now, they’re trying to ignore us when the majority demands with a clear voice, “NO GOVERNMENT TAKEOVER OF HEALTH CARE!”

We MUST NOT let them ignore us any longer!  [CALL your Senators today!]

TAKE ACTION: Believe it or not, even Howard Dean is now saying “the best thing to do right now is kill the Senate bill and go back to the House” — of course, he’s saying it because he wants it to be MORE socialistic… but he’s saying the right thing, even though it’s for the wrong reason!

P.S. As Heritage.org is reporting, just today, the Washington Post released a poll finding that 51% of adults oppose Obamacare, with 40% in strong opposition. Meanwhile only 44% support the bill with only 25% feeling strongly about it. Digging deeper we find that 66% of Americans believe Obamacare will increase the federal budget deficit, 53% believe it will cause their own health care to cost more, 55% believe it will increase the country’s health care costs overall, and 50% believe it will not improve their quality of care. These findings echo an earlier CNN poll which found that 61% of Americans opposed Obamacare, with 79% believing it would add to the deficit and 85% believing it would raise their taxes.

We have a VERY GOOD CHANCE to defeat this bill on the next cloture vote. First… The legislative text of the new Reid bill HAS NOT
BEEN RELEASED. There is NO BILL for your Senators to actually
see and read, and NO BILL for you to see and read!

THE REAL WORK AND THE REAL DEALS ARE TAKING PLACE BEHIND CLOSED DOORS!

Second, what’s really happening amounts to pure bribery.

   With YOUR MONEY, Reid and Obama are trying to buy
   the votes of swing senators to the tune of hundreds of
   millions of dollars. Reports indicate that Sen. Ben Nelson
   may have been offered $500 million in earmarks for his
   state in appreciation of his support of ObamaCare.

Also, we’re told that in Reid’s latest plan, the “public option”

not include a public option!) And does it matter…

   With or without a formal “public option,” ObamaCare
   means government-run health care. ObamaCare still is
   based on the unconstitutional “individual mandate,”
   includes massive tax increases, imposes an oppressive new
   government bureaucracy and puts the government in
   charge of your health care.

Poll Deaf. If you feel ignored by the House of Representatives, you’re not alone. A Rasmussen Reports poll this week reaffirmed that more Americans oppose (52%) health care legislation than favor (45%) it. Nevertheless, as last Saturday’s legislative spectacle attests, Speaker Pelosi is still singing the health care tune.

Go Directly to Jail.  As you know, in the 1,990-page bill that squeaked (220-215) out of the House on Saturday there’s plenty of bad policy to fill this letter (and several more). What you may not know is that failing to comply with the new requirements in this legislation could land you in jail – for up to five years!

The most appalling effect of the Affordable Health Care for America Act is the extent of control which the federal government would exercise over individual health care decisions. The legislation requires you to purchase health insurance, whether you need it or want it, and dictates the parameters of your policy. What’s more, failure to purchase insurance would result in a slew of fines and, as this letter from the Joint Committee on Taxation makes clear, failure to pay the fines would result in criminal penalties including “a fine of up to $250,000 and/or imprisonment of up to five years.”

AARP: Abandoning Seniors, Advancing AARP. In apparent disregard for the interests of senior citizens, the AARP supported the House health care bill, including the following provisions:

• $500 billion in overall budget cuts for Medicare.
• $170 billion in budget cuts for Medicare Advantage-the program’s entire budget-leaving 12 million American seniors with fewer health care options.
• A 20% cut in doctor’s pay, forcing doctors to take on more patients and spend less time with each person in their care.

Obamacare Mob Rule

The sound you hear is our Constitution being buried in its coffin of tyranny and indifference.  Like awakening to a nightmare of life in Orwell’s 1984 or Huxley’s Brave New World, only unable to really wake up, such is the case with the horrific visions of waiting lines and drone-like people in gray clothing obediently taking their daily dose of numbing soma…

 

In The End of America, In the Middle of the Night, Adam Murdock, MD, asks:

 

Since when did the Constitution provide for a health care guarantee? Since when did the Constitution grant the Congress the power to force Americans into a health care dystopia? What good is a Constitution if we choose to ignore it? What good is a Constitution if the Congress simply chooses to create a new one in their own graven socialist image?

It surely is a sad state of affairs when the People speak loudly, clearly and resourceful, and those to whom the message is directed willfully disregard the information, the intent and those producing it.  It is WE who will surely pay for our non-representing Representatives’ decisions this weekend in regard to Healthcare.

Universal Healthcare will takeover 1/6 (20%) of the US economy. 
As we are already reeling from the unsustainable levels of government spending & debt and unemployment has reached at least 10% nationwide, the middle-class is going to be hardest hit.  The wealthier Americans will be able to pay any additional taxes required by new HC legislation and lower-income people won’t owe taxes or will receive subsidies, so we will be burdened with upholding the entire system!

 

Yet, the forgotten man will be the middle class working American who now already struggling against the burden of economic ruin will be forced to pay fines or even face possible jail time for not complying with our government’s take over of his/her health care. As this tax sinks in, the middle class will be forced downward into the ranks of the working poor and therefore into the ranks of government rationed medical care. Inevitably, government healthcare will swallow the whole of the medical insurance world and there will be no escape. (Murdock)

 

If this were any other country, the people would take to the streets with rocks, guns and anything else to signify their anger and disgust with the government.  There would be uprisings and broken windows and riots and tear gas and police barricades and everything else you see on TV about other countries’ political upheavals… 

 

Oh, but this is America, the land of the somacose and the home of the bound!

 

What’s more despicable is a situation in which the whole of Republicanism SAVE ONE votes against this travesty.  Let’s turn now to Pamela Geller’s (Atlas Shrugged) ample description of this weekend’s malpractice of justice.  (All emphasis in red is mine.)

 

Under cover of darkness and treachery, a stunned and grieving nation, reeling from the largest terrorist attack on a military base in U.S. history, was victimized and terrorized again — but this time from a different enemy within, our elected officials. The snakes pulled a fast one on a Saturday night. Instead of passing emergency legislation to protect the American people (the only real purpose of the government) from the infiltration of jihadists in the crucial institutions of national security.

The Wall Street Journal is calling Nancy Pelosi’s 1,990-page government takeover of healthcare the “worst piece of post-NewDeal legislation ever introduced.”The Journal says it will create an “unrepealable middle class entitlement” that will cause taxes to “rise precipitously” and will result in “all medicine” being “rationed via politics.”

 

The CBO cost estimate is coming in at $1.055 trillion and that’s just scratching the surface. For months we have all been working feverishly to make sure that government run health care legislation is not passed. We have done it all:We’ve yelled.We’ve called.We’ve emailed.We’ve written.We’ve rallied.We’ve even marched on the Capitol.

 

Still our cries and concerns have not been heard. We have cried tears of despair and shouted in frustration, but still many are not listening. 

 

We know you all are so very tired. We know that each of you work tirelessly each and everyday, trying to do your part, to make a difference.  Each of you has done a great job at speaking your hearts.

 

Some are calling for more angry protests, even storming the Capitol, but let’s not give the media another chance to falsely portray us as an unruly mob.

 

INSTEAD, LET’S REMIND THEM WHY WE ARE FIGHTING FOR OUR COUNTRY.

 

Together, with the doctors of Take Back Medicine and the Association of American Physicians and Surgeons, the Patriots of Tea Party Patriots Live, Resistnet, and the Tea Party Express, are going to STAND TOGETHER, speak from the heart, and remind Washington we will stand together to protect this country!

 

On Thursday, November 5^th, Representative Michele Bachman (MN) will stand on the steps of the Capitol in Washington, D.C. She will be joined by other Members of Congress and many Patriots from across this country.  People will be traveling from coast to coast, to stand shoulder to shoulder with other Patriots in Washington this week.   We know most of you can’t get to Washington again so soon…..  So let’s join Representative Bachman and other Patriots by turning out at State Capitols and Congressional district offices across the country.

 

Instead of yelling or protesting, let’s sing “God Bless America” at 12:30 pm EST at every location across the country.  Let’s send a message that says “WE STAND TOGETHER!”

When the White House made its jobs creation announcement, none of the news media reported that another government program — immigration — completely wiped out any overall benefit for unemployed Americans.

What YOU Can DO about Obamacare NOW

We are in for what may very well be the most important political fight of our lifetime.  And we mean lifetime literally.  In the future, our very lives may depend on our actions today. 

You probably know at least 1 person who has had an abnormal medical test.  Maybe you have had it yourself.  Maybe it was a family member or a loved one.  After that first abnormal test, the doctor usually schedules more tests, maybe refers you to a specialist, and works to determine what the diagnosis is.  Waiting for those tests and the results can feel like the longest wait in the world.  You worry that something is wrong. You hope that nothing is wrong.  You think, “Is it serious?  Do I have cancer or some other terrible disease?  Is it malignant?  Maybe it will be benign.  Maybe the doctors are wrong.”  You wait.  And you worry.  Luckily, in our health care system today in America, that wait is only days or maybe a couple of weeks.  And, if the diagnosis is serious and requires further treatment, doctors work to treat your problem right away. 

Imagine if that wait were months and months long.  Imagine if some government bureaucrat said, “You will have to wait for 4 months until we have the time and doctors to treat you.”  Imagine that few days or weeks turning to months.  What if the problem were serious?  What if the wait time caused you to miss your treatment window?  What if it were your mom? Your spouse?  Your child?  This happened to Shona Holmes.  A couple of weeks ago, Amy Kremer and I had the privilege to meet Shona Holmes and hear her story first hand.  Had Shona waited for her nationalized health care in Canada to actually diagnose and treat her, she would have died.  Click here to watch her story on Patients United Now and her Fox News Interview. 

The liberal tax and spend politicians want to takeover our health care.  They want control not just of our wallets but also our very lives.  These politicians realize what is at stake.  If the bill passes, bureaucrats in Washington will determine when you can see a doctor, which doctor you can see, and whether or not you can actually have treatment.  Is this what you want?  Are you going to let politicians takeover your health care? 

The bill that will allow the government to takeover our health care was introduced today.  It is 1,018 pages long.  The politicians know that if you have time to read the bill you will not want it.  They are not willing to allow honest debate and honest review of amendments.  Speaker Pelosi and the House of Representatives are trying to rush passage of this bill, this one thousand eighteen page bill, by the time they go on summer vacation on July 31.

Are you willing to fight for control of your personal health care?  Do you want the government to takeover your health care? 

The heat is on!  It is make or break time. 

If you do not want the government to take control of your physical well being in addition to your wallets, then you must act.  We must act quickly, decisively, and relentlessly.  Here is what you can do: 

1.  Attend the Tea Party Patriots Health Care Freedom Protest in your area.  Take an hour off of work.  Are your health care and the physical well being of your family members important enough to you to spend an hour making sure your voice is heard?  While you are there, we need you to do 3 things:  sign the Free Our Health Care Now Petition, Sign the Letter to your Representative or Senator and hand deliver it to their office, and hold your signs opposing government takeover of your health care.

2.  On Monday, July 20, call every single Blue Dog Democrat, those are Democrats who say they are fiscally conservative, (click here for list and phone numbers).  Record your answers in this form (click for the form). We want to keep up with the number of calls, emails, and faxes that are made into Congress.
 
3.  Be prepared to make more phone calls next week.

Have a little more time?  Want to do a little more?  –  Forward this message to everyone in your list.  Ask them to take these actions as well.  Make phone calls to your friends and family to make sure they understand what is at stake.

Really want to go a little further?  Have the time to make a large commitment to keeping control of your health care? – Print the Free Our Health Care Now Petition.  Now, take that petition and walk up and down your street asking your neighbors to sign it.  Ask them if they will print the letter and email it to their elected officials.  If they are passionate, then forward this email to them and ask them to call each and every Blue Dog Democrat.

Letter to Your Elected Officials on Capitol Hill

(Note:  This is an example — change this up a bit and add your own words.  Boilerplate letters don’t carry much weight!)

Dear Representative ___________ and Senators______________,
 
As your constituent, a fellow American, and citizen of your state, I am writing to ask you to vote against any bill that will give the government increased control over healthcare and will lead to nationalized health care in the United States. 
 
The documented accounts of rationing of medical services, long wait line for diagnosis and then longer wait lines for treatment, and inferior medical care cannot be ignored.  In America, while our health care system may not perfect, we are able to choose our doctors, the doctors determine the best course of treatment for their patients, and there is no rationing of medical services.  Additionally, in America, uninsured patients cannot be denied treatment in public hospital emergency rooms, so those uninsured patients are able to get the treatment they need in a timely manner.
 
If you insist on voting for government politicians to take over my health care, I implore you to do 4 things:

Promise and commit to change your health insurance and your immediate family members’ health insurance to the new government run program.

Promise and sign the pledge to read the bill and allow public input on the final bill for a minimum of 72 hours before voting.

Guarantee you will vote against any bill that will lead to rationing of medical services, that will limit in any way the ability for a patient to choose his or her doctor, and that will cause longer wait times before diagnosis and before treatment.

Guarantee you will vote against any bill that will increase the cost of medical care through increased taxes, reduced competition of medical providers, reduced competition of private sector health insurance.

Will you make these four commitments to your voters and American taxpayers?  If you will not make these four commitments, why won’t you?  What stands in your way of making these promises to insure that the superior medical care in America is not compromised in anyway?  Why would you vote for a bill and then be unwilling to live by its consequences as an example to your constituents?
